General

Anyone accessing our website (https://www.hkhitman.com.au) and other channels, such as emails or chat platforms (collectively the “Site”) and using the services (the “Services”) offered by HK Hitman (“HK Hitman”, “we”, “our” or “us”) must be of 18 years of age or above.

By accessing the Sites and the Services, you agree to the terms and conditions and privacy policy of HK Hitman.

HK Hitman provides only a tipping service and does not provide financial advice.

HK Hitman offers a choice of subscription packages for horse racing.

By subscribing to HK Hitman tips, members must acknowledge and agree that they will only place bets with licensed betting service providers.

Members must confirm that they are over the age of 18 and agree to be bound by these Terms and Conditions upon subscribing.

We reserve the right to alter these terms and conditions at any time.

Subscriptions

We offer a choice of subscription packages for horse racing.

To become as a subscriber of HK Hitman, you must:

Be 18 years of age or older;
Select a subscription package available, as offered on the Site;
Accept the terms and conditions at the time of becoming a subscriber;
The cost of the subscription package selected must be paid in advance.

At the time of entering into a subscription package, you will acknowledge that you agree with these terms and conditions.

After having purchased the subscription package, we will send you a confirmation email of the package and further information about the package.

If you wish to make any changes to your subscription such as changing your subscription package, amending your payment details or changing your contact details, you are required to inform us by writing us an email at info@hkhitman.com.au.

Automatic renewal products (“subscriptions”)

All subscription packages will be set to “Automatic renewal” by default at the checkout page on the Site.

If you choose for the automatic renewal of your subscription:

You authorise us to automatically charge your credit or debit card on a recurring basis until you cancel;
You agree that you are liable to pay the payments as identified in the subscription package that you enter into;
You agree to provide us with current credit or debit card details and provide updated details of the card when required and/or requested;
If you wish to cancel an automatic renewal, you need to do so by emailing us directly at info@hkhitman.com.au. We will endeavour to respond to you and confirm your cancellation via an email reply within 24 hours of having received the email.
Automatic renewal of your subscription will occur unless you cancel your subscription one (1) day prior to the date of renewal of the automatic subscription.
If you cancel a subscription after it has been renewed, you will continue receiving the Services for the period of payment provided.

If you choose for the non-automatic renewal of your subscription:

The services provided during the subscription period will be ended as stated in the confirmation email of the order purchased.
We may email you less than seven (7) days before the end of any subscription period to inform you to confirm the end of the subscription.

Pricing of the Services

The price of a subscription package will be displayed at the time of purchase and by purchasing a package, you agree to pay the price as stated at the time of purchase. All prices are in Australian Dollars and inclusive of GST.

HK Hitman can amend the pricing schedule of the subscription packages by providing no less than 14 days’ notice to you.

If you are already on an automatic renewal subscription, HK Hitman will continue your automatic payment arrangements in accordance without amendment to the pricing schedule, unless the subscription is cancelled or placed on hold by the customer.

If you are on a non-automatic subscription, any increase in the pricing schedule will be applied at the time of your renewal of the product.

Cancellation

You may cancel your subscription at any time. If you cancel your subscription, you will receive an email to confirm the end date of your subscription.

We may cancel your subscription at any time if we contend that you have breached these terms and conditions.

Refunds

There are no refunds offered on any automatic renewal subscriptions.

If you purchase a non-automatic product by mistake and you notify us prior to the service being provided, we will refund your subscription fee in full. We do not offer refunds for services that have been completed, unless there is a technological fault.

Liability of HK Hitman

We are not responsible for any loss, damage, cost suffered by any of our subscribers, or any disputes between our members and any betting agencies. Any monetary investment made by a subscriber is done so on their own volition and at their own risk and we are not liable whatsoever arising from those actions. We will not offer and are not liable for any refunds or compensation to subscribers in relation to any monies lost.

HK Hitman only provides a tipping service. We do not provide any financial advice as part of our Services.

All tips provided by HK Hitman are sent to all members at the same time by email. HK Hitman holds no responsibility if there is any delay to any member due to their email service provider.

We promote responsible gambling. It is the subscriber’s responsibility to control their gambling activities. Please ensure that when implementing received tips that members do so in a controlled manner that is suitable to their own circumstances.

If a person brings a claim against us in relation to the actions of a subscriber on our Sites, the subscriber will indemnify us from and against all damages incurred in relation to that action. If a subscriber and/or a person on behalf of a subscriber and/or any other person brings a claim against us in relation to any loss or damage suffered by a subscriber, the subscriber will indemnify us from and against all damages incurred in relation to that action.

Activity of subscribers

In using the Services and accessing the Sites, you agree to not undertake any acts that are deemed illegal or/or are prohibited by any laws that relating to the Services and/or are actions that we deem to be inappropriate including:

Any act that breaches the privacy of another person or otherwise breaches legislation in relation to privacy;
Conduct that would be considered to be illegal such as conduct that is defamatory, racist, threatening or conduct that would breach our network security;
Any act that would be deemed to either defame or libel either us or any other person or entity.

All material and content on our Sites are copyright protected.

Your use of the content and material produced to you as part of your subscription does not grant you any rights, title or interest in the Sites and/or the material and content referenced therein. You do have a licence to access the Sites in accordance with your subscription.

You are not entitled to reproduce, copy or transmit any part of the Sites and/or the material and content referenced therein without written permission from us.

You agree that the purchase of the Tips from HK Hitman are for your own use only and you agree not to provide them to other third-parties including bookmakers, or on-sell them in any form. You agree that HK Hitman provides information and takes what measures it can to protect prices for legitimate subscribers and that HK Hitman’s reputation would be damaged by the provision of its Tips to other parties due to prices contracting more quickly than they otherwise would. You agree that if you provide Tips to any third-parties including bookmakers, or on-sell them, that HK Hitman can claim from you an amount equal to the Full Monthly Website List Price x the number of people selections are sent to x the number of months involved x a multiplier to allow for reputational damage, calculated individually for each service where a breach has occurred, as well as all legal fees incurred in satisfying the claim. You acknowledge and agree that this represents a genuine estimate of loss that would be incurred by HK Hitman.

You will need to pay these damages whether you directly on-sold the Tips yourself, sold them through another entity or associate, or even if you simply forwarded them to someone who is on selling them, with or without your knowledge. The sharing of the Tips in any form is strictly prohibited.

Force Majeure
The following policy applies for events out of our control, such as:

cyber warfare, cyber attacks, ransomware attacks or cyber-sabotage;
war, hostilities (whether war is declared or not), invasions, acts of foreign enemies, civil war, sabotage or piracy;
rebellion, terrorism, revolution, insurrection, military or usurped power, riots, civil
commotion or disorder;
operation of the forces of nature such as earthquakes, hurricanes, lightning, typhoons or volcanic activity;
work stoppages
outbreaks of disease, epidemics, pandemics or quarantine; and
acts of government authority, whether lawful or unlawful.

If a Force Majeure event impacts on Hong Kong horse racing, refunds are not applicable but the service and subscriptions will be paused until it can resume (hence no time will be lost and your subscription will be extended by the period of time the service had to be paused).

Waiver

The fact that we fail to do, or we are delayed in doing, something we are entitled to do under these terms and conditions, does not amount to a waiver of our right to do it.

Invalidity and severability

If any part of these terms and conditions is found to be illegal, unenforceable or invalid, then that part is removed from these terms and conditions and the remaining provisions are not affected.

Jurisdiction and governing law

Your use of the Sites and these terms and conditions are governed by the law of New South Wales and you submit to the non-exclusive jurisdiction of its courts.

Subscription Termination

We reserve the rights to refuse, cancel or reject a member’s subscription at any time at any time and without notice, at the Promoter’s sole discretion. Refunds will be issued for the remaining duration of the subscription.

Amendments to the Terms and Conditions

From time to time, we may update these terms and conditions and our privacy policy. We will publish the amended terms and conditions on our website, upon which they will become effective. We will also inform you of any amendments that materially impact you.

If you continue to use our Services after the amended terms and conditions are published, you are agreeing to be bound by the amended terms and conditions.
